I-4-005 DIVISION OF LITIGATION ANALYSIS AND IMPLEMENTATION FUNCTIONS AND RESPONSIBILITIES
Working with other OHA components, DLAI develops and implements an appeals strategy which identifies the issues and types of cases which OHA believes should be appealed. In response to OHA-identified cases and to requests for appeal recommendations from the Litigation Staff, DLAI obtains the views of affected OHA components and formulates a proposed OHA position on appeal.
B. Court Trend Information
Based on its analysis of the court trend information collected by OCA operating divisions, DLAI:
1. Develops and maintains the Circuit Court Case Reporter contained in Volume II, Part 1 of HALLEX.
2. Identifies problem areas and makes recommendations for change; e.g., to clarify policies, revise regulations, give refresher training, etc.
3. Prepares and updates significant court case requirements which OCA staff use in reviewing court cases.
C. Class Actions
DLAI tracks pending class actions, forecasts potential workload impact, makes recommendations to other OHA components regarding workload impact, and prepares monthly and quarterly reports on class action activities and status. DLAI coordinates OHA's implementation of class action orders and prepares instructions for implementation.
DLAI coordinates OHA's response to discovery requests.
DLAI administers and coordinates the Freedom of Information Act (FOIA) and Privacy Act (PA) provisions for OHA.
DLAI coordinates OHA's response to proposed Social Security Acquiescence Rulings.
